MAWIO wapangua mashtaka mawili
MAHAKAMA ya Hakimu Mkazi Kisutu, jijini Dar es Salaam leo imewafutia mashitaka mawili Siomon Mkina, Mhariri wa Mawio na Jabir Idrisa, mwandishi wa gazeti hilo na Tundu Lissu, Mbunge wa Singida Mashariki, anaandika Faki Sosi.Ni katika kesi ya uchochezi iliyofunguliwa na serikali dhidi ya watu hao pamoja na mchapishaji wa gazeti la Mawio, Ismail Mahboob wa Kampuni ya Flint Graphics.
Mashitaka yaliyofutwa ni shtaka namba moja na shtaka namba tano ambapo pande zote mbili (utetezi na mashtaka) zimeridhia kufutwa kwa mashtaka hayo mbele ya Hakimu Thomas Simba.
Mashtaka hayo ni kupanga njama za kufanya chapisho la uchochezi na kosa la pili ni kuwatisha wananchi wa Zanzibar kwamba, machafuko yanawaweza kutokea Zanzibar.
Awali, Poul Kadushi, Wakili wa Serikali aliiomba mahakama hiyo kuondoa shtaka namba moja na tano kutokana na kukosekana kwa idhini ya Mamlaka ya Mkurugenzi wa Mashitaka (DPP).
Peter Kibatala, Wakili wa Upande wa Washitakiwa amesema kuwa, Wakili wa Serikali amefanya busara kukubaliana na upande huo kuwa, mashtaka hayo yalikuwa na upungufu kisheria.
Hakimu Simba amefuta mashtaka hayo baada ya kusikiliza hoja za pande zote mbili na kwamba, watuhumiwa hao wanakabiliwa na mashitaka matatu pekee.
Shitaka la pili la kuchapisha chapisho la uchochezi linawakabili Idrisa mshitakiwa namba moja, Mkina ambaye ni mshitakiwa namba mbili na Lissu, mshitakiwa namba nne.
Shitaka la tatu la kuchapisha magazeti bila ya kuwa na hati ya kiapo kutoka kwa msajili wa magazeti linamuhusu Mahboob, mshitakiwa namba tatu.
Shtaka namba nne la kuwatia hofu wananchi wa Zanzibar ya kutopiga kura kwa kuhofia umwagikaji wa damu.
Hata hivyo, Kadushi amejibu hoja zilizowasilishwa mahakamani hapo na upende wa utetezi kuwa, zina kasoro.
Kadushi amedai kuwa mashitaka yote yaliyobaki katika shauri hilo yameanishwa kwa kila kosa na kifungu chake na maelezo ya kosa hilo.
Amedai kuwa, kifungu namba 32 (a), (b), na (c) cha makosa ya jinai kimeanisha kuwa, na nia ya kutenda kosa ni kosa na kutenda kosa ni kosa.
Peter Kibatala amedai kuwa, bado hoja za Kadushi hazina mashiko na kwamba, mashtaka hayo ya matatu yaliyobaki hayana mashiko kutokana na kwamba, Sheria ya magazeti haifanyi kazi Zanzibar na kuwa chapisho hilo lingeleta athari Zanzibar na sio Tanzania Bara ambapo yupo waziri husika.
Kibatara amewasilisha hoja ya kufutwa kwa mashtaka yaliyobaki kwa madai kuwa, hayana mashiko kwa mujibu wa kifungu 31(a)(b) na (c) cha sheria ya magazeti ambayo inampa haki raia kuikosoa serikali.
Kesi hiyo itatajwa tena 11 Julai mwaka huu ambapo hakimu atatoa maamuzi ya kufutwa ama kutofutwa kwa shauri hilo.

TUNDU Lissu, Mnadhimu Mkuu wa Kambi Rasmi ya Upinzani ameseme kuwa, vitendo vinavyofanywa na serikali ya sasa ni vya hovyo, anaandika Faki Sosi.Lissu ambaye ni Mwanasheria Mkuu wa Chadema pia Mbunge wa Jimbo la Singida Mashariki amesema hayo leo muda mfupi baada ya kumaliza kusikiliza shauri lake katika Mahakama ya Hakimu Mkazi Kisutu, jijini Dar es Salaam.
Kwenye shitaka hilo, Lissu pamoja na washitakiwa wengine watatu wanadaiwa kufanya makosa mbalimbali ikiwa ni pamoja na uchochezi kupitia gazeti la Mawio la tarehe 14 Januari 2016.
Kwenye gazeti hilo lililoandikwa kichwa cha habari ‘Machafuko yaja Zanzibar’ Lissu alinukuliwa kama mchangiaji wa gazeti hilo ambapo tayari limefutwa na serikali.
Nje ya mahakamani hiyo Lissu amesema “nchi yetu imeingia katika giza nene, huyu dikteta uchwara, naomba nirudie tena, huyu dikteta uchwara anahitaji kupingwa na kila mwananchi.
“Kila msema kweli wa nchi hii. Huu ni wakati wa kujitokeza na kusema hii ni nchi ya vyama vingi, hii ni nchi inayotambua haki za binadamu kwenye Katiba yake.
“Hatuwezi tukakubali nchi iongozwe kwa kauli za mdomo za mtu mmoja hata kama amechaguliwa kuwa rais,”
Akizungumzia kesi iliyofunguliwa na kuhusishwa kwake Lissu amesema, kesi iliyofunguliwa na serikali dhidi yake na wahariri wa gazeti la Mawio ya uchochezi, ni ushahidi tosha kuwa nchi imeingia kwenye giza nene la udekikteta.
Amesema, hata sheria ya magazeti ya mwaka 1976 ipo wazi kwamba, kuikosoa serikali sio uchochezi.
“Mashtaka haya yanayodaiwa kuwa ni ya uchochezo, sio ya uchichozi hata kidogo. Nilichosema, niliulizwa na waandishi … niliosema uchaguzi wa marudio ya uchaguzi Zanzibar yanaweza kuviingiza visiwani hivyo kwenye machafuko na umwagaji damu… ni kauli ya raia anayefahamu na hapendezwi na mwenendo wa serikali” amesema Lissu.
Amesema kuwa, hata sheria ya magazeti inasema kuwa kitetendo chochote chenye lengo la kueleza ubovu wa serikali au mamlaka yake sio kosa.
“Nilichosema mimi kuwa serikali hii na matendo yaki ni ya hovyo… huyo dikitekta uchwara anahitaji kupingwa na kila mwananchi,” amesema.
“Kama wanafikiria watatutisha kwa kutuleta mahakamani, tutamkabili mahakamani na tutamkabili nje.
“Ni wakati wa wazalendo kusema kuwa, Tanzania ni nchi ya vyama vingi na ina Katiba na sheria. Katiba yetu inatambua haki za binaadamu na moja haki za binaadamu ni kueleza ujinga wa watawala wanapofanya ujinga,” amesema.

Powerful Nominated TNA senator Paul Njoroge has hinted that the Uhuru Kitchen cabinet (read Mt Kenya Mafia/top statehouse operatives) are at crossroads to retain DP Ruto as president Uhuru’s running-mate in the 2017 general election.
The senator who was nominated on account of his back stage role in the Jubilee 2013 campaigns (super strategist) was very categorical that the debate among Statehouse operatives is whether DP Ruto is FIT to be Uhuru’s running mate.
Hon Njoroge are petitioned the DP to stop talking about 2022. The seemingly aggrieved senator further argued that , instead of Ruto dragging us to 2022 conversation he should start asking himself if he is fit to be Uhuru Kenyatta’s running mate 2017.
“I think he should be fighting first to retain runningmate position” Hon Njoroge told local media.
It is an open secret that DP Ruto owes his position to his friendship with the president BUT those who surround Uhuru are not so keen on him. Matters were made worse when president Obama lectured Uhuru on what was said as DP Ruto’s high handedness in dealing with important national issues.
It is not clear if President Obama’s rant got anything with Senator Njoroge’s outbursts or it is purely a mt Kenya issue.

Deputy President William Ruto has urged leaders to embrace political realignments saying it is a reflection of democracy and a globally accepted practice.
The Deputy President noted that issues such as good policies, fair play and progressiveness of a party attract those discontented elsewhere.
“Changing one’s allegiance or alliance is normal and should not be viewed as a result of compromise or inducement,” he said.
Ruto said leaders were free to make political decisions and that should not be construed to mean that they have been induced.
“Leaders are free to make their informed decisions and engage in political realignments in charting their political future. This does not mean that they have been compromised,” Ruto said, urging Kenyans to make informed decisions and refuse to be enslaved to certain political parties ahead of the next year’s polls.
“It is only slaves who cannot change their minds. Any person in this 21 st century who still believes in slavery believes in something of the past,” he said.
The Deputy President was speaking at the Masii Catholic Church in Mwala Constituency, Machakos County, during the Sunday sermon.
He took issue with leaders who are bent on criticizing the government for working with leaders from across the political divide in addressing the challenges facing the country.
Ruto said the government would continue working with leaders irrespective of their political affiliations.

He further pointed out that it is a constitutional right for all Kenyans to access government services regardless of their voting choices.
Ruto observed that opposition leaders who want to work with the government do not need permission from anybody, terming such an analogy as primitive.
He noted that it is unbelievable that some leaders were opposed to those keen on initiating development projects that can transform the lives of Kenyans.
“People who are opposed to leaders engaging in talks or sharing development ideas remind us of slavery where slaves must get permission from their masters,” Ruto said.

How Mt Kenya DELIVERS Sensitive message to Rift Valley over DP Ruto 2022 VOTES and the REST of Kenya

1. When an obviously inebriated Tony Gachoka – a close buddy of Uhuru told Ruto on national TV to shape up or ship out, the next day, Ruto was told not to mind the drunk, but the message was home.
2. Then next, when the same Ruto had to be told that 2022 ‘sio Lotto, ni ndoto’, it is no less than Uhuru’s own Governor, one William Kabogo that was tasked with the errand. Thereafter, Ruto was told it was a slip of the tongue, he forgave Kabogo and the two even hugged in public, but the message was home.
3. Later, when Raila Odinga had to be told that if he sustained his anti corruption crusade, a bullet would be driven through his head, it is no less than Uhuru’s own MP, one Kuria that was tasked with the errand. Thereafter, the two had fish together, but the message was home.
4. Over the weekend, when Ruto had to be told that there is no guarantee that he will be running mate next year, it is Senator Paul Njoroge that was tasked with the honours of breaking the sad news to Ruto. What is worth noting here is that Njoroge is a nominated Senator who was nominated by, serves at the pleasure of, and answers to the beck and call of Uhuru. And like majority of the TNA members in Nakuru County, he originally hails from Uhuru’s Kiambu County. He will soon apologize, but the message will be home.
5. BUT remember it all started with Meru governor Peter Munya… but his delivery skills were not so good since he was seen to be to angry with Kiraitu and thus risking loss os seriousness of the message…
